NEW JAPAN PRO-WRESTLING 50th Anniversary Logo User Guideline
Article 1
1. This Guideline (“Guidline”) is designed to set forth the necessary matters concerning the private use of the "NEW JAPAN PRO-WRESTLING 50th Anniversary Logo" (“Logo”), which was produced to commemorate the 50th year anniversary of the founding of New Japan Pro-Wrestling Co., Ltd.(“NJPW”)
2. In the Guideline, person who uses the Logo is defined as "User".
Article 2
The Guideline is subject to the private use of the Logo. If organizations, for example, companies, associations and so on, (regardless of whether it has a commercial purpose or not, and it has corporate status or not) wish to use the Logo, please refer to the "Guidelines for Organizations", which is going to be made hereafter.
Article 3
1. NJPW grants a non-exclusive license to use the Logo under the Guideline.
2. User may use the Logo only for non-commercial purposes, and shall not sell or distribute items using the Logo in any name or manner for which charge a price, or use the Logo to advertise items for sale or distribution.
3. User shall not distribute items using the Logo beyond the scope of private use, even if no price is charged.
4. User shall not transform, process, modify, or alter the Logo in any way. However, User may convert the data format without changing the appearance, and may enlarge or reduce without changing the aspect ratio. Furthermore, the use of the Logo in combination with images created by the User is not prohibited.
5. User shall use the Logo for himself/herself, and shall not redistribute to others.
Article 4
1. User may download the Logo on the New Japan Pro-Wrestling 50th Anniversary Special Site (https://50th.njpw.co.jp/en/).
2. User who downloads the Logo is deemed to have agreed to the Guideline.
Article 5
1. User shall not use the Logo for any of the following acts.
①acts that violate or may violate laws and regulations or public policies
②acts that harm the interests or the rights of third parties
③acts that support or endorse specific individuals, groups, political parties, religious organizations, etc., or acts that may mislead to support or to endorse these.
④expressing a specific political, religious, or ideological claim
⑤acts that harm the honor or image of NJPW, the affiliated athletes, and all other parties concerned with NJPW
⑥acts that may mislead people into thinking that NJPW sponsor, authorize, affiliate, or have relationship with User.
⑦acts that may mislead as NJPW’s official productions.
⑧acts that slander or discriminate against third parties, or acts that harm the reputation or credibility of third parties.
⑨acts that may encourage criminal or illegal activities.
⑩threatening, racially prejudiced, obscene, or offensive expressions.
⑪other acts that NJPW deems inappropriate.
2. User who violates the preceding paragraph shall immediately terminate the use of the Logo in accordance with NJPW’s instructions. In addition, the User shall be liable for compensation for all damages resulting from such violation.
Article 6
1. The copyright and all other rights of the Logo belong to NJPW. NJPW does not intend to waive any of rights through the Guideline.
2. The meaning and interpretation of terms in the Guideline shall be in accordance with the provisions of the Copyright Act (Act No. 48 of 1970) except as otherwise provided in the Guideline.
Article 7
NJPW expressly disclaims all warranties whatsoever that the use of the Logo does not infringe on the rights of third parties. In the event of a dispute or trouble with third parties, including other User, arising from the use of the Logo, the User shall be responsible for handling the dispute or trouble.
Article 8
The period of use of the Logo is from January 1, 2022 to December 31, 2022. User is not required to cease the publication of anything User have published during the usage period, or to dispose of anything User have created, but User shall not make any new use of the Logo after the end of usage period.
Article 9
The Guideline is governed by and construed in accordance with the laws of Japan without regard to the principles of the conflict of laws thereof, and any and all disputes arising out of or in connection with the Guideline shall submit to the exclusive agreed jurisdiction of the Tokyo District Court or the Tokyo Summary Court at the first instance.
Article 10
The Guideline is subject to change without prior notice to User. By using the Logo after the changes take effect, User is deemed to have agreed to the revised Guideline.
